Jakarta — The Special Task Force for Upstream Oil and Gas Business Activities (Satuan Kerja Khusus Pelaksana Kegiatan Usaha Hulu Minyak dan Gas Bumi (SKK Migas)) has implemented SNI ISO 37001:2016 on Anti-Bribery Management System (SMAP) in conducting supervision and control over the upstream oil and gas industry. This step is expected to help creating a transparent and efficient upstream oil and gas industry that can provide the greatest benefits to the country.
SNI ISO 37001:2016 is an instrument designed to help an organization developing, implementing, and consummating anti-bribery program. This instrument contains series of action, control, or procedure to be performed for prevention, detection, and handling of a bribe.
Chairman of SKK Migas, Amien Sunaryadi, said that the application stage of SNI ISO 37001:2016 within SKK Migas has already started since last mid-year. “Currently, we are entering the stage of implementation. SKK Migas has started the integration of SNI ISO 37001:2016 into SKK Migas business process and has communicated SNI ISO 37001:2016 both internally and externally,” Amin revealed in the Seminar of ISO 37001:2016 held by SKK Migas in cooperation with Presidential Staff Office (KSP) and National Standardization Agency (BSN) in Jakarta, Tuesday (27/3).
In this implementation phase, SKK Migas has taken several steps, such as, issuing regulations underlining any prohibition from receiving and providing bribe which prevails for all management, employees, and outsourced personnel within SKK Migas. This step will be followed-up by verification and feasibility test to all human resources of SKK Migas. Additionally, SKK Migas has also held series of socialization session on the application of SNI ISO 37001:2016 with goods and services providers within the environs of SKK Migas. In the future, these goods and services providers will need to pass through the verification and feasibility test before they start calling for cooperation with SKK Migas. Socialization session on SMAP is another step that has been taken for PSC Contractors acting as operators of oil and gas working area. It is expected that these PSC Contractors will apply SNI ISO 37001:2016 in the future within each of their organization. It is necessary to understand that the upstream oil and gas industry has a long and multi-party business chain. This kind of situation creates an opportunity for bribery. On the other hand, the existence of SNI ISO 37001:2016 will certainly minimize such risk.
“These steps will be consummated continuously. We expect that in the middle of this year, the application of SNI ISO 37001:2016 within SKK Migas would have obtained accreditation from the anti-bribery management certification institute (Lembaga Sertifikasi Manajemen Anti Penyuapan (LSMAP)) which constitutes an international standard for anti-bribery management system,” Amien stated.
The National Standardization Agency (BSN) expressed their appreciation for the steps taken by SKK Migas in the application of SNI ISO 37001:2016. “SKK Migas started to implement SNI ISO 37001:2016 to help creating a transparent and efficient upstream oil and gas industry that can provide the greatest benefits to the country,” Head of BSN, Bambang Prasetya, said.
Bambang is optimistic that SKK Migas will easily implement it and will be able to obtain the certificate of conformity with this standard. It is also expected that what was done by SKK Migas will systematically become an inspiration for other similar organizations to apply the SNI ISO 37001:2016. “SNI ISO 37001:2016 will be easily integrated into the organization culture and other management systems which have already been in place, such quality management system, environmental management system and food security management system,” Bambang explained.
BSN keeps encouraging all organizations both corporate and non-profit organization in Indonesia to implement SNI ISO 37001:2016. To date, there are three (3) organizations that have successfully obtained the certificate of conformity with SNI ISO 37001:2016, namely, Makassar Agricultural Quarantine Center of the Ministry of Agriculture, Inspectorate of National Anti-Narcotics Agency (BNN), and PT. Hari Mukti Teknik (KANABA).
The application of SNI ISO 37001:2016 is one of the follow-ups from the Presidential Instruction Number 10 of 2016 concerning Actions for Corruption Prevention and Eradication. “BSN identically adopted the standard of ISO 37001:2016 to be SNI ISO 37001:2016. It means, the application of SNI has referred to international practices and has been acknowledged internationally,” Bambang stated.
Until this present time, there are four (4) conformity assessment bodies which have been accredited by the National Accreditation Agency (KAN) and are ready to perform the conformity assessment activities of SNI ISO 37001:2016, namely PT. Garuda Indonesia, Asricert Indonesia, PT. TÜV NORD Indonesia, and PT. Mutu Agung Lestari.
BSN is optimistic that the number of accredited conformity assessment bodies will increase in the near future considering that this standard is very important to the organizations who are willing to run their operation in a better, effective and transparent way which will eventually head to the world-class organization.
The SNI ISO 37001:2016 provides requirements and guidelines for the development, application, maintenance and modification of anti-bribery management system. The structure contained in SNI ISO 37001;2016 has been in line with ISO High-Level Structure (HLS). As earlier stated by Bambang, it means that each standard of management system issued by ISO can be simply well integrated from the administrative side as well as documentation method as it has the same structure. This scope of standard encompasses bribery in all of public, private and non-profit sectors, including bribery by and for an organization or its staffs, and bribe paid or received by any third party.
Amien stated that the application of SNI ISO 37001:2016 in SKK Migas helps the institution to focus more on the performance of its main duties and functions in upstream oil and gas industry by avoiding and eliminating interferences from bribery practices. The application of SNI ISO 37001 can also maintain SKK Migas reputation in accordance with the principles of good governance, which are transparency, accountability, responsibility, independency, fairness, and integrity. The SNI ISO 37001:2016 may also provide a systematic framework for anti-bribery. “The application of SNI ISO 37001:2016 helps establishing a more efficient upstream oil and gas industry that can contribute maximally to state revenues,” Amien concluded.
